All previous are correct in stating that the anser will depend on the state you located. In NY A use variance ahs 4 standards that must be shown, these include 1, application of the zoning regs would deprive the applicant of all economic use or benefit, 2 the alleged hardship is unique to that property, 3 the request if granted will not alter the essential charecter of the neighborhood and 4 that the alleged hardship is not self created. These standards would be very difficult to meet therefore use variances should be difficult to obtain.
