I am interrested in any news on pending "Bert Harris" claims or transportation "concurrency" issues.
A claim in Citrus County is scheduled for hearing on the 25th but might be contiued. It has been dragging for years.

The Planning and Environmental Law journal had a blurb about a BJH case a few months ago......If I can find it....I'll let you know.....

I have heard, from a prominent attorney in the state of Florida, that no Bert Harris claim has ever been awarded. They are too difficult to prove. Several have been settled, however. If you find one that has been awarded, let me know.
Ok here are a few related cases:
Upheld Cases Related to Fla. St. Statute 70.001:
2-8-06 Russo Associates, Inc. v City of Dania Beach Code Enforcement Board, District Court of Appeal
Take a close look at this case:
7-14-2006 Brevard County v. Stack, District Court of Appeal; Bert J. Harris Act is Constitutional; $1million claim
Rejected Claims:
1-18-06 Palm Beach Polo Inc. v. Village of Wellington District Court of Appeals Florida
The first two may have been settled, but if they were, it was because the intermediate court made it clear they had to do it......at least that's how I would see it from what little info I've got on these cases.....

Russo was a reversed decision of the trial court by the 4th DCA, but I can't find that it was awarded. It appears time limitations were challenged by the circuit court, but found in compliance by the DCA.
Define "wet lands" "tidal wet lands" "vernal pools"
