    Special exception application for substance abuse facility

    Our Planning and Zoning Board has received a request for a Special Exception for a residential substance abuse facility with fulltime housing. The present zoning is RMH15. The property was purchased at the top of the real estate market when it was operated as a mom and pop vacation rental on the water. The property was approved to be converted into 8 high end waterfront condos. This use would have justified the cost but the market collapsed. Now the owner wants the Special Exception in order to generate more income than the old mom and pop rentals. It has been operating for a couple of years as a substance abuse facility without the zoning change. I believe the request for a zoning change is due to community complaints. Thoughts on restricting private enterprise, neighborhood good will and harmony etc.

    Is the facility state-licensed? Here that kind of licensure requires zoning compliance. If the neighborhood rises up in opposition it might be a losing battle for the owners. Here there was a teapot tempest over a "personal care home" application that was withdrawn, then an act of violence precipitated a showdown. Care home status was changed to make them compliant.
