Need help. Here's my situation:
I want to develop (under current zoning) a property I own in a subdivision. Zoning allows a residential cluster development. I can get the deed restrictions amended, too. The problem I am facing involves a non-mandatory Homeowner's Association that, in its documents, has additional requirements that prohibits anything except single family residential and no sub-dividing. I am not a member of the HOA and its documents are not attached to the deed. If I proceed, I am likley to be faced with multiple civil suits from the HOA. I may win the suits, but I will be drained financially and distracted.
