Six-foot ice cream cone controversy headed to trial

    http://www.fox19.com/story/22945130/...eaded-to-trial

two citations by the Greenhills Police Department, one for not having a permit and the other one states a mounted roof sign is prohibited.
The Greenhills sign ordinance states: "No building shall have a roof mounted sign, except for signs mounted on the face of a mansard roof."
However, owner says the cone is not a sign
Is it a roof mounted sign or an ornamental decoration ?
    Oddball
Why don't you knock it off with them negative waves?
Why don't you dig how beautiful it is out here?
Why don't you say something righteous and hopeful for a change?
    From Kelly's Heroes (1970)

Are you sure you're not hurt ?
No. Just some parts wake up faster than others.
Broke parts take a little longer, though.

It is a sign. Now if the entire building were designed to resemble a cone, I would let it pass.

If its advertising a product, its a sign. But yes, if the building was in the shape of an ice cream cone, that might be different. But if this is just a plain old shoppe with a giant ice cream cone on it, its no bueno.

Pretty straightforward - yep, a sign.
People will miss that it once meant something to be Southern or Midwestern. It doesn't mean much now, except for the climate. The question, “Where are you from?” doesn't lead to anything odd or interesting. They live somewhere near a Gap store, and what else do you need to know? - Garrison Keillor

Sign. Trying to skirt regulations by pretending like you don't understand why it would be considered a sign? Here's your sign violation.
A common mistake people make when trying to design something completely foolproof is to underestimate the ingenuity of complete fools. -Douglas Adams

I agree that it's a sign, mainly because it's advertising the project inside the buildling. What if it was a huge gorilla? On top of an auto sales place? Is it still a sign if it's not anything that alludes to the project or service for sale?

You put the thing on a house and we can argue about bad taste in art, but if you business sells soft serve, it looks like a sign to me.

"Is it bothering anybody? I know that there are laws and things that have to be followed, but there was never any malice intended putting it up,"
And this statement just tells me you knew better, but it's not hurting anyone - sounds like a case for the special consideration thread.
