Townhouses in a condominium form of ownership

We are currently reviewing a townhouse project in Maryland that wants to take advantage of a condo form of ownership. How can we address setback, net lot area, lot width, street standards, and other zoning standards for townhouses owned as condominiums. What do you do if a landowner of such a townhouse wants to build an addition or deck? They don't own the land. This project proposes a lot coverage easement (LCE) for each townhouse to use as their own. Help Thanks

Treat it just as you would a traditional multi-family project. Dimensional requirements are tied to the structure, not individual units. As you said, the "landowner" is the association, the owner of the unit owns no land. A deck or other addition should have approval of the association--a good reason to review the homeowners agreement. Also, check your state statutes, as many detail condo ownership.

We regulate structures, not forms of ownership (the State does that). It's all one big lot to us, and we apply the same standards for condos as we do for attached single family homes or multi-family homes.

One thing you could do is make them go through a planned unit development process or a conditional use process. Do you have site plan review? That can be used to settle all kinds of issues.
